Terms of Service

These terms are the agreement between you and SpeakUp Gym. They cover what you can expect from us, what we expect from you, and what happens when something goes wrong.

SpeakUp Gym puts you in a live voice room with another person. That makes the conduct rules in sections 5 and 6 the most important part of this document, and the part we enforce most readily.

1. This agreement

By creating an account or using SpeakUp Gym you accept these terms. If you do not accept them, do not use the service. If you are agreeing on behalf of an organisation, you confirm you are allowed to bind it.

We may update these terms. If a change materially affects your rights we will tell you in the app before it takes effect, and continuing to use the service after that is acceptance.

2. Who may use SpeakUp Gym

SpeakUp Gym is for adults. You must be 18 or over, and you must be able to enter a binding contract where you live. You may not use the service if a previous account of yours was terminated for breaking these terms.

We check age by asking rather than by verifying documents. That places the responsibility on you, and we act on reports: an account we find to belong to someone under 18 is closed and its data deleted.

4. Identity verification

We may ask you to verify your identity before using some features. Today that is a manual review request that an administrator approves. If we introduce document or photo checks in future, we will ask for your explicit consent first and update the Privacy Policy before any collection begins.

5. How to behave in a room

Every session pairs you with a real person who is practising something difficult and is probably nervous. Treat them accordingly.

6. Harassment and abuse

The following will end your access, usually without warning:

Every session ends with a rating, and you can report or block anyone. Reports are reviewed by a person. If you feel unsafe, leave the room first and report afterwards. Nothing in these terms asks you to stay in a conversation that has become abusive.

7. Recording rules

You may record yourself. You may not record your partner. The optional recorder in the practice room captures your own microphone and nothing else, and it is built that way on purpose.

Capturing your partner's voice by any other means, or publishing any part of a session, is a breach of these terms and may also break the law where you or they live. Do it and your access ends.

8. Content and licence

What you create stays yours: your recordings, your profile, the feedback you write. We do not claim ownership of it.

You grant us the limited licence we need to actually run the service: to store your content, to show it back to you, and to show the parts intended for another member, such as the feedback and rating you give a partner, to that member. That licence exists so the product can function and for no other purpose. We do not use your content to advertise, and we do not publish it.

You are responsible for what you submit, and you confirm you have the right to submit it.

9. Subscription plans

Some features need a paid plan. What each plan includes is set out on the pricing page, and that page is the current description. Plans differ in the rooms they open, the number of sessions a day, the monthly gems allowance and access to the Learning Hub.

We may change what a plan includes or what it costs. If a change reduces what you already paid for, it takes effect at your next renewal, not during a term you have paid for.

10. Billing and renewal

You choose to be billed monthly or annually. The price shown at checkout is what you pay, in the currency shown, including any tax we are required to collect.

A subscription runs for a set term and its access ends when that term expires. Buying again before your current term ends adds to the time you have left rather than replacing it, so you never lose days you already paid for.

Payment is handled by our payment provider. If a payment fails, access reverts to the free tier until it succeeds.

11. Cancelling

You can cancel at any time. Cancelling stops the next charge; it does not shorten the term you have already paid for, and you keep your paid features until it runs out. You can also delete your account entirely from Settings, which ends access immediately.

12. Refunds

If something we sold you does not work, tell us and we will fix it or refund you. Contact us within 14 days of the charge.

We will not usually refund where:

Nothing here removes rights you have under Philippine consumer law, including the Consumer Act of the Philippines, or under the consumer law where you live. Where those rights conflict with this section, they win.

13. Gems and virtual items

Gems are an in-app currency with no cash value. They cannot be exchanged for money, transferred between accounts, or redeemed outside SpeakUp Gym, and they are not refundable except where the law requires it. Items bought with gems, such as avatar frames, are a licence to use them inside the service, not property.

Gems included with a plan are granted for that period and do not accumulate indefinitely. If your account is closed for breaking these terms, unused gems are forfeited.

14. Suspension and termination

We can suspend or end your access if you break these terms, if we are required to by law, or if your behaviour puts another member at risk. Where it is reasonable to warn you first, we will. Where someone's safety is involved, we will not.

You can end this agreement at any time by deleting your account. Sections 8, 15, 17, 18, 19 and 20 survive it.

15. Our intellectual property

SpeakUp Gym, its name, its design, its software, its prompts and its Learning Hub material belong to us or our licensors. Your subscription buys access, not ownership. Do not copy, resell, scrape or redistribute any of it, and do not use it to train a machine-learning model without our written permission.

16. Availability and changes

We aim to keep the service running and available, but we do not guarantee it will be uninterrupted. We run maintenance, we fix things, and we change features. A session depends on another member being available to practise with, which is not something we can promise at any given moment.

17. Disclaimers

SpeakUp Gym is a practice service, not education, certification, therapy or professional advice. We do not promise any particular improvement in your speaking, or any outcome in an interview or examination.

Other members are not our employees and we do not vet them beyond the safety measures described here. To the extent the law allows, the service is provided as it is, without warranties of any kind.

18. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential loss, for lost profits, or for anything another member says or does. Our total liability to you for any claim is limited to what you paid us in the 12 months before it arose.

Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.

19. Indemnity

If your use of the service, or your breach of these terms, causes a claim against us by somebody else, you agree to cover the reasonable costs of dealing with it.

20. Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have jurisdiction over any dispute.

Talk to us first. Almost everything is settled faster by email than by lawyers, and we would rather fix your problem than argue about it. If you are a consumer, this section does not remove your right to bring a claim where you live, or to use a consumer dispute body available to you.
